The long outstanding CCRC Referral of Victor Nealon is now nearing its hearing .
In this case in which DNA has been found from an unknown male on the victims intimate clothing which was not Victor Nealon’s despite this the Crown continue to seek to oppose the appeal .
The Crown argue that notwithstanding this evidence the conviction could still be considered safe relying on other evidence .
It ought to be said that the other evidence which the Crown seek to rely upon is in our view extremely shaky and it doesn’t come close to addressing the significance of the DNA .
Of course its not appropriate as the Court’s hearing is pending to say very much more about the evidence to be heard in this case save to say we remain convinced the case to prove Victor Nealon’s innocence is overwhelmingly strong .
It is expected a directions appointment will be fixed imminently with a Final Appeal Hearing during the autumn .
